Please  carry the following documents for H1 B visa stamping to facilitate smooth processing of your visa stamping.
 

• Take the original H1 Approval Notice, and a copy of LCA
• Take the original employment verification letter from employer.
• Take a copy of any proof of labor filing or I140 Approval Notice used for securing the H1 beyond 6 years tenure.
• Take a copy of the end-client letter. Always expect the consular officer to confirm the authenticity of the end-client letter, by calling the undersigned company.
• Take a copy of the contract.
• Take copies of 4-5 months of paystubs.
• Copies of Educational Documents and Educational evaluation
• Take photographs of the worksite – inside and outside with you in the pictures.
• Be prepared to explain the job duties in articulate fashion. Be prepared to answer the following questions.
  •  How are the job responsibilities so complex that it requires a degree? You should refer the job descriptions detailed on the end-client letter.
  • Who supervises your work? End-client? This is a tricky and leg-pulling question. You should refer the job description on the end-client letter to explain how the employer has control on the employee. Few hints to answer the question: While a software consultant reports to the end-client, he is expected to work independently without any supervision and deliver the results. (While the end-client manages the project and deliverables,) the employer is responsible for offering training on the additional skills required on the job, for doing the performance evaluation, offering health insurance benefits and doing salary increments/decrements. The employer reserves the right to decide/change the project that an employee can work on, whereas the end-client does not have the authority to assign the employee to another employer.
  • How your degree is related to the job that you are doing? Any job is considered o be eligible for H1, only if the job is complex enough to require a Bachelors degree in a related field. This question should not arise if you are a programmer and you have a computer science degree. This question should not also arise, even though if you don’t have computer science degree, as long as you have more than 3 years of work experience. (This is because USCIS considers 3 years of programming experience to be equivalent to 1 year of academic education; and therefore they consider the candidate to be holding a bachelors degree equivalent to a minor in computer science). This question might arise, if a computer programmer has less than 3 years of work experience and holds an irrelevant degree such as mechanical engineering or commerce degree. In that situation, you need to be prepared to explain how your project requires the knowledge that you gained in your engineering/commerce subjects.

Port of Entry:  You need to be prepared to show your LCA, Drivers license and AR11 at the port of entries, when you return from abroad. We have identified some issues at the Newark port of entry. They are asking for additional information/ documentation. If you need to travel abroad it is a good idea to avoid Newark Airport.
